Federal Court asks California for opinion on Boy Scouts case

The 9th circut federal appeals court is considering a ruling on a Boy Scouts case and they have asked for the opinion of the Supreme Court of California before they continue.

At question is whether the Boy Scouts are allowed to legally lease certain parts of San Diego since they are deemed as a religious organization. By being a religious organization they are technically not allowed to lease land as then it would violate the federal establishment clause which makes it so the government can't show preference to any given religion. The boy scouts are seen as a religious organization as they have an oath to God that each member must perform.
